General
Terms and Conditions for
Subscription Contracts

1: Subscription Contract

The contract for the regular supply of any Body By Snow Jay LLC products is concluded when an order is placed by the subscriber and confirmed by the company. 

Commencement of delivery constitutes confirmation. 

2: Term of the Contract

I. In the case of fixed-term subscriptions, the contract ends when the term of the contract expires or the contract is canceled. II. Cancellation is possible up to four weeks before the end of the subscription period. Cancellation notices received after that are considered on the next termination date. III. All cancellation notices must be in writing through an email to Body By Snow Jay LLC 

3: Payment 

I. Subscription prices include product prices only with discount included for purchasing subscription, customer will be in charge of paying for shipping and taxes, if applicable. II. The fees for a 12-month subscription can be paid through our website bbsjllc.com, Etsy, Instagram, or Facebook Shops. 

In each case, the subscription price is payable in advance. 

Long-term prepayment discounts are not available. 

4: Right to Withdraw from Subscription Contracts 

You have the right to withdraw from this contract within 14 days without stating any reasons. The withdrawal period is 14 days from the date on which the first order was placed or on which you or a third party named by you, who is not the carrier, takes the first consignment of goods into your/their possession. To exercise your right of withdrawal, you must inform us at our email address bbsjllc@gmail.com of your decision to withdraw from this contract in a clear statement (e.g., by email). 

You may use the standard withdrawal form provided, although this is not a requirement. The withdrawal deadline is met as long as you dispatch the withdrawal notice before the withdrawal period expires. Consequences of withdrawal If you withdraw from this contract, we are obliged to reimburse all payments that we have received from you, including delivery costs (except any additional costs resulting from your opting for a form of delivery other than the cheapest standard delivery offered), immediately and at the latest within 14 days of the day on which we receive your notification of withdrawal from this contract. For this reimbursement, we will use the same method of payment that you used for the original transaction, unless a different arrangement is explicitly agreed with you; on no account will you be charged any fees for this repayment. 

We may refuse to make the repayment until we receive the returned goods or until you provide evidence that you have returned the goods, whichever occurs first. The goods you have received must be returned or delivered immediately to address provided in email follow up to customer’s subscription cancellation request, in any event no later than 14 days after the date on which you inform us that you wish to withdraw from this contract, The deadline is met as long as you dispatch the goods before the 14-day period expires. 

You are only responsible for any loss of value of the goods if such loss of value is the result of handling not required to determine the suitability, characteristics and function of the goods. In the case of digital content, the right of withdrawal expires when contract performance commences, i.e., when the content is downloaded.

5: Late Payment

The company may suspend deliveries in the event of late payment by the subscriber. Dunning expenses of up to €5 may be charged for each reminder. Bank charges for direct debits that are not paid shall be borne by the subscriber. 

6: Delivery

I. Delivery is by carrier or by owner to customer. Customer can purchase shipping and decide for a carrier to be used, owner may also deliver depending on if the customer is located in the Albuquerque, Bernalillo, or Rio Rancho locations.

7: Changes and Redirection of Mail

I. Changes of mailing address must be notified to the company in good time. Changes in the method of payment and changes of account are permitted only after the payment period selected has expired as to avoid unnecessary charges. 

8: Interruptions in Delivery

In the case of force majeure (stoppages, strikes, lockouts) and in the event of interrupted delivery due to circumstances beyond the company's control, we will not be liable for failure to deliver the products or for any compensation. 

9: Price Changes

Price changes or changes in the terms of delivery will be published in a prominent position on the company website, shops, and social media handles. 

10: Liability of The Company

Please be advised that the products for sale on Body By Snow Jay LLC’s website are not intended to diagnose, cure, mitigate, prevent or treat any disease or health condition and they are not to be considered a Medical Device. 

Body By Snow Jay LLC products have not been evaluated by the Food & Drug Administration.

Test each product on a small portion of skin before usage. 

By purchasing our products, you recognize and accept the fact that some natural ingredients, essential oils in particular, may still cause sensitivity in susceptible individuals and that Body By Snow Jay LLC will not be held responsible for such occurrences.

You as a customer accept FULL responsibility if continued use of or purchase of products without complete or extensive knowledge about product ingredients and/or functions. You have the right to ask prior to purchase via email or social media direct messaging.

Body By Snow Jay LLC is not liable for any individual reaction to any particular ingredient. Remember to read our labels and ingredient lists carefully and follow the appropriate directions for use. If you have a specific allergy or sensitivity, do not use ingredients that may trigger a reaction. An allergy patch test is highly recommended if there is any doubt or history of skin reactions.

If the product contains an allergen please alert the owner directly of all allergies to better accommodate. If this is not done prior to purchase, then you relinquish all liability from Body By Snow Jay LLC.
